How we quote, book, shoot and deliver, and the rules for this website. Your signed quote always comes first.
Who these terms are for
They apply to every project with HOVR Studios, unless your signed quote says otherwise.
HOVR Studios is a brand of Neuval SRL, Brussels (the details are in our legal notice). These terms apply to every quote, order and project with us, and to your use of this website.
- Where your signed quote or contract differs from these terms, the quote or contract wins.
- Your own general terms only apply if we accept them in writing.
- "You" is the client who orders the work. If you order as a private person, the consumer section below also applies to you.
Quotes
Every project starts with a written quote that lists exactly what's included.
- A quote lists the deliverables, the shoot days, the locations, the revisions included and the price.
- A quote is valid for 30 days.
- Prices for businesses exclude VAT. Prices for private clients include VAT (21 % in Belgium) and every other charge.
- Travel, permits that carry a fee, and extras you ask for later are quoted before we commit to them.
Booking and payment
A deposit holds your date. The rest is due on delivery.
- Your date is booked once we receive the signed quote and a deposit of 50 % of the total.
- The balance is invoiced on delivery and due within 14 days. Monthly plans are invoiced at the start of each month.
- Late payments by businesses carry interest and compensation as Belgian law on late payment in commercial transactions provides.
- We send the final files once the invoice is paid.
Weather, airspace and cancellation
If flying wouldn't be safe or legal on the day, we move the flight. The pilot's call on the day is final.
Drones don't fly in rain, strong wind or poor visibility, and airspace can close at short notice, for example when a temporary no-fly zone is activated for an event or a summit. The pilot in command decides on the day whether a flight is safe and legal.
- If weather or an airspace restriction stops the flight, we reschedule it at no extra cost. Ground filming can go ahead as planned if you want.
- If you cancel more than 14 days before the shoot, we refund the deposit minus the costs already incurred. Within 14 days, the deposit is kept in full.
- If you cancel within 48 hours of the shoot, 50 % of the quoted price is due.
- If we have to cancel for a reason on our side, you get your deposit back in full, or a new date if you prefer.
Permits and locations
We handle the airspace paperwork. You get us access to the places we film.
We plan every flight in the EU open category unless the quote says otherwise, and we don't fly over crowds. We file the flight with skeyes where the airspace requires it, request geozone approvals and ask the commune for permission to take off and land in public space. In Brussels, allow two to three weeks near the airport, royal estates or public institutions.
- You arrange access to private property and the owner's permission to film there, unless the quote says we do.
- A flight that needs an authorisation (for example over a crowd, or higher than the open category allows) happens only once it's granted. Its cost and lead time are in the quote.
- Fees charged by authorities or venues are passed on at cost.
People on camera
Anyone recognisable who is featured signs a release before the film is shared.
An image of a recognisable person is personal data, and that person has image rights. Agreeing to be filmed is not agreeing to publication. We bring release forms that cover both.
- For your staff, guests or talent, you make sure they're informed before the shoot, and you collect or help us collect their releases.
- We blur or cut people who ask not to appear, where the edit allows.
Revisions
One round of changes is included. More are possible, at €90 an hour.
- One round of revisions is included, unless the quote says otherwise. The new version is back within 24 to 48 hours.
- A round is one consolidated list of changes to the edit, the grade or the music.
- Further rounds, and changes to the brief after the shoot, are billed at €90 an hour, quoted before we start.
Delivery and archive
Final files arrive in a shared folder. We keep the raw footage for 12 months, then delete it.
- Delivery dates, formats and versions (for example 16:9 and vertical cuts) are in the quote.
- Your files arrive in a shared folder that doesn't expire. Keep your own copy as well.
- We keep the raw footage for 12 months after delivery, then delete it. The raw files are €150 per shoot day, and longer storage can be quoted.
Copyright and your licence to use the film
Once paid, you can use the films everywhere and for good. We keep the copyright and ask before we show the work.
- Once the invoice is paid, you may use the delivered films on every channel, paid ads included, worldwide and with no time limit.
- We keep the copyright in the footage and the edit.
- We ask before we show the work in our portfolio or on our social channels.
- Licensed music and stock come with their library's licence. If a use falls outside it, we say so in the quote.
Liability and insurance
We fly with the insurance Belgian law requires. Our liability is limited to the price of the project.
Belgian law requires anyone flying a drone for work in the open category to hold civil liability insurance for bodily injury and property damage to third parties (Royal Decree of 8 November 2020, article 12). We fly with that cover.
- Except in case of fraud, intentional fault or gross negligence, our total liability is limited to the price of the project.
- We aren't liable for indirect loss, such as lost profit or lost opportunity.
- Nothing in these terms limits the rights consumers have under Belgian law.
Using this website
Look around freely. Don't copy the films or the code.
- The films, photos, text, logo and code on this site belong to Neuval SRL or to those who licensed them to us.
- You may share links. You may not download, re-upload or reuse our footage without written permission.
- We keep the information here accurate, but it's general information, not a quote or legal advice. Drone rules change: check the date on any guide.
- Links to other sites are for convenience. We don't control them.
If you're a consumer
Private clients keep all their rights under Belgian consumer law, and a free mediation service if we can't agree.
If you order as a private person at a distance (by email, online or by phone), you normally have 14 days to withdraw from the contract without giving a reason.
If we can't solve a disagreement together, you can turn to the Consumer Mediation Service (Service de Médiation pour le Consommateur / Consumentenombudsdienst).
Applicable law and courts
Belgian law applies. Business disputes go to the courts of Brussels.
- These terms and every project are governed by Belgian law.
- Disputes with businesses go to the courts of Brussels.
- Consumers keep the protection of the law and the courts that apply to them.
